The most important and first thing you should do when you receive a settlement offer on your injury claim is discuss the settlement with your car accident attorney. The only way to ensure your rights are not violated and you receive the full amount under laws in your state is by learning the laws and all of your options legally. Your attorney will be able to give you advice as to if the settlement is fair or if you should hold out for more or go to court.

A settlement of a personal injury claim can even occur after a lawsuit has been filed. The person, insurance company, or other agency that is being sued for your injuries would in most cases rather settle out of court than fight out the case in court. When the settlement is sent for your approval, look over the documents carefully. Your legal counsel will be able to explain such things as the amount of money he/she believes your case is worth, other verdicts and settlements he/she has seen in other cases like yours, as well as your chances of winning if the case goes to trial. All of this should be discussed before you agree to a settlement. Your lawyer will explain what will happen if you decide to go to trial and exactly what may occur such as more of your personal information being revealed, any weakness he/she may see in proven your case.

If your personal injury believes, the settlement is a fair and just settlement according to your injuries and situation you should listen to your lawyer. If your attorney on the other hand, believes this would be a bad settlement, then again listen to their advice.
